Offshore Provisional Patent Application

    I have a business friend in Australia who wants to submit a Provisional Patent Application himself.  Can he use the US Patent office website forms to do that?  Also, he wants potential protection as soon as possible from the date of mailing.  My thought was that if he overnighted it to me, I could use the US Post Office to establish that date but we don't know about sending it directly from Australia.  Can you provide incite?

    The fastest way would be electronically via the USPTOs EFS-Web. While there are benefits to being set up with a customer account number and special login security code (which take weeks) anyone can file on EFS-Web right now as a non-registered user without those things. It is not hard to use and the forms are all on the PTOs web site. However it is filed, i would caution against a false sense of security from a provisional application drafted by someone without training. If you decide to go with you re mailing it from the U.S., it does not help much unless you use Express Mail and follow the USPTO rules regarding Express Mail. www.uspto.gov/ebc/portal/efs/efsweb-overview.pdf ---George
